By accessing or using NovaX ("Service"), a product of HyperBrainLabs ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

NovaX is a social media management platform that allows users to:

• Connect and manage multiple social media accounts (Twitter/X, LinkedIn)
• Create, schedule, and publish content across platforms
• View analytics and performance metrics
• Generate content using AI-powered tools
• Manage posting schedules and automation

3. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you:

• Are at least 13 years of age
• Have the legal capacity to enter into these Terms
• Are not prohibited from using the Service under applicable laws
• Will comply with these Terms and all applicable laws and regulations

4. Account Registration

To use certain features of the Service, you must create an account. You agree to:

6. Social Media Platform Compliance

When connecting your social media accounts, you agree to comply with the terms of service and policies of each platform, including but not limited to:

• Twitter/X Terms of Service and Developer Agreement
• LinkedIn User Agreement and API Terms of Use

We are not responsible for any actions taken by social media platforms against your accounts due to violations of their policies.

7. Content Ownership and Rights

7.1 Your Content

You retain ownership of all content you create, upload, or post through the Service. By using the Service, you grant us a limited, non-exclusive license to use, store, and process your content solely for the purpose of providing the Service.

7.2 AI-Generated Content

Content generated using our AI tools is provided for your use. You are responsible for reviewing and editing AI-generated content before publishing. We do not guarantee the accuracy, appropriateness, or originality of AI-generated content.

7.3 Our Content

The Service, including its design, features, and functionality, is owned by HyperBrainLabs and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

8. Beta Service

NovaX is currently in beta. During this period:

• The Service is provided "as is" and may contain bugs or errors
• Features may be added, modified, or removed without notice
• Service availability may be limited or interrupted
• We may reset or delete data during the beta period
• Your feedback helps us improve the Service

9. Fees and Payment

The Service is currently free during the beta period. We reserve the right to introduce paid features or subscription plans in the future. You will be notified of any pricing changes before they take effect.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HYPERBRAINLABS AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruptions or failures
• Actions taken by social media platforms
• Content posted by users or third parties
• Any damages resulting from your use of the Service

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Indemnification

You agree to indemnify, defend, and hold harmless HyperBrainLabs and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may also terminate your account at any time by disconnecting your social media accounts and contacting us. Upon termination, your right to use the Service ceases immediately.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms and changing the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in courts of competent jurisdiction.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HyperBrainLabs regarding the Service and supersede all prior agreements and understandings.
